The right to request an adjustment of working hours: A legal and judicial approach

Abstract

Among the instruments for reconciling work and family life regulated by the Workers' Statute, the right to request an adaptation of the working day has recently acquired extraordinary relevance, as it is a measure that makes it possible to modify the working day to meet the worker's needs for reconciliation. However, its application is not free of questions. Thus, the very characterization of the right, the procedure to make it effective or the conditions that must be met to exercise it have been the subject of analysis by courts and tribunals, giving rise to an interesting doctrine.
